Liability Waiver and Assumption of Risk

I/We hereby understand and acknowledge that the training, programs and events held by the Karasu Tengu Academy, LLC (KTA) may expose me to many inherent risks, including accidents, injury, illness, or even death. 

I/We assume all risk of injuries associated with participation including, but not limited to, falls, contact with other participants, the effects of the weather, including high heat and/or humidity, and all other such risks being known and appreciated by me. 

I/We hereby agree in the event there are any disputes or controversies that arise between the parties to this liability waiver, then the parties are waving their right to litigate these issues in court and instead elect to have these disputes resolved through arbitration. The parties agree any claim must be submitted to a binding arbitration as part of the alternative dispute resolution process. The parties agree that any disputes are to be arbitrated through the American Arbitration Association and that the parties agree to abide by the Commercial Arbitration Rules of the American Arbitration Association. Except as otherwise provided by law, all personal actions, except action for slander or libel, may be brought only within 3 years of the act or omission complained of, except that when the injury and its causal relationship to the act or omission were not discovered and could not reasonably have been discovered at the time of the act or omission, the action shall be commenced within 3 years of the time the plaintiff discovers, or in the exercise of reasonable diligence should have discovered, the injury and its causal relationship to the act or omission complained of. (N.H. Rev. Stat. Ann. § 508:4)

I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity. 

I/We acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in. After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and the Karasu Tengu Academy (KTA) LLC furnishing services to me, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE AND RELEASE the Karasu Tengu Academy (KTA) LLC, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in the Karasu Tengu Academy (KTA) LLC training, programs and/or events. 

By my signature I/We indicate that I/We have read and understand this Waiver of Liability. I am aware that this is a waiver and a release of liability and I voluntarily agree to its terms.

COVID-19 Liability Waiver

I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing.
I further acknowledge that Karasu Tengu Academy, LLC (KTA) has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.
I further acknowledge that Karasu Tengu Academy, LLC (KTA) can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff, and other members and their families.
I voluntarily seek services provided by Karasu Tengu Academy, LLC (KTA) and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19.

I acknowledge that I must comply with all set procedures to reduce the spread while at Karasu Tengu Academy.
I attest that:
* I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
* I have not traveled internationally within the last 14 days.
* I have not traveled to a highly impacted area within the United States of America in the last 14 days.
* I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
* I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities.
* I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.
I hereby release and agree to hold Karasu Tengu Academy, LLC (KTA) harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the salon, or that may otherwise arise in any way in connection with any services received from Karasu Tengu Academy, LLC (KTA). I understand that this release discharges Karasu Tengu Academy, LLC (KTA) from any liability or claim that I, my heirs, or any personal representatives may have against the gym with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Karasu Tengu Academy, LLC (KTA). This liability waiver and release extends to the gym together with all owners, partners, and employees.
